Terms of Use

This Terms of Use agreement (the “Agreement” or “Terms”) is a legal contract between you ("you," "your," "user," or "member") and Frontier Financial Group, Inc., doing business as New Frontier Data (“FFG,” "we," or "us"). These Terms govern your access to and use of any websites operated by FFG, including but not limited to frontierfinancials.com, newfrontierdata.com, equio.newfrontierdata.com, and any subdomains or mobile applications (collectively, the "Site"); and all products, platforms, software, services, content, features, and tools offered through the Site, including but not limited to Equio™, NXTeck™, MarketEQ™, ShopEQ™, and AdEQ™ (collectively, the "Services" or "Products").

By accessing or using the Site or Services, or by registering an account, purchasing a product, signing an insertion order (IO), or otherwise engaging with our technology platforms, you agree to be bound by these Terms, including our Privacy Policy and any other applicable policies or product-specific provisions.

Section 1:

1. Defined Products and Platforms

FFG provides a suite of proprietary data and marketing solutions through the following platforms:

    • Equio™: A cannabis industry data analytics platform offering market trends, forecasts, and business intelligence.
    • NXTeck™: A mobile-first advertising and attribution platform that activates data-driven campaigns using anonymized consumer datasets, real-time location signals, and proprietary pixel tracking to measure performance across retail, QSR, and advocacy sectors.
    • MarketEQ™: A retail behavior analytics engine that delivers insights into market activity, shopper density, and demographic shifts.
    • ShopEQ™: A physical location intelligence tool for retailers and brands to understand real-world foot traffic, customer journey, and walk-in conversion.
    • AdEQ™: A performance measurement layer built for omnichannel media, including view-through attribution, exposure frequency, and campaign lift analysis.

 

All Products and Services are governed by these Terms unless otherwise specified in a product-specific license, insertion order, or subscription agreement.


2. License and Permitted Use

FFG grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site and Products for your internal business purposes only. You may not:

  • Resell, sublicense, or distribute the Products or Services, in whole or in part, unless expressly authorized.
  • Export, extract, or reverse engineer data, analytics models, tracking mechanisms, or consumer identity mapping from any part of NXTeck™, MarketEQ™, ShopEQ™, or AdEQ™.
  • Use any Services or reports generated to compete with, copy, or create facsimiles of FFG products or systems.

Clients using NXTeck™ or AdEQ™ services must adhere to the terms set forth in any signed IO or service agreement, including restrictions on attribution data, pixel tracking, data enrichment, and audience targeting. Unless otherwise stated, all performance data generated is proprietary to FFG and shall not be disclosed or reused beyond the original campaign intent.


3. Data Privacy and Compliance

FFG complies with all applicable data privacy laws including the CCPA, GDPR, and U.S. state-specific consumer privacy statutes. All targeting and attribution delivered through NXTeck™, AdEQ™, or ShopEQ™ is performed using anonymized mobile ad identifiers and does not involve the resale or exposure of personally identifiable information (PII).

You agree not to use any Service to target, track, or identify individuals in a manner that violates applicable privacy laws or FFG policy. You also agree not to attempt to de-anonymize any data delivered to you through our platforms.


4. Ownership and Intellectual Property

All Services, platforms, analytics engines, reports, targeting logic, data visualizations, tracking pixels, software, and content—including those within Equio™, NXTeck™, MarketEQ™, ShopEQ™, and AdEQ™—are owned by FFG and/or its licensors. You acquire no ownership rights through use, and all rights not expressly granted are reserved.

You may not use FFG trademarks, trade names, logos, or proprietary labels without express written permission.


5. Subscription and Insertion Orders

Your access to certain Services may be governed by a subscription agreement or insertion order. Subscription Services will auto-renew unless cancelled in writing in accordance with your agreement. IO-based services (e.g., media activation through NXTeck™ or measurement via AdEQ™) are subject to the campaign dates, budgets, deliverables, and attribution terms set forth in the IO.

Unless otherwise stated, all fees are non-refundable. Usage data and performance analytics may be retained by FFG for compliance, reporting, or optimization purposes.


6. Restrictions and Termination

You may not:

  • Use the Products or Site to infringe on any intellectual property or violate any law.
  • Circumvent access controls, pixel logic, or attribution boundaries defined by your IO.
  • Share or redistribute reports, dashboards, or enriched data beyond internal use without express permission.

FFG reserves the right to suspend or terminate access without notice if you breach these Terms or misuse the Services.


7. Confidentiality and Attribution

All campaign methodologies, targeting logic, attribution models, and performance results derived from NXTeck™, MarketEQ™, ShopEQ™, or AdEQ™ are confidential. You may not disclose these methodologies to third parties or use them to design competing products.

When publicly sharing campaign performance or media results powered by FFG, you agree to credit "New Frontier Data" or "NXTeck™ by New Frontier Data" as the source.


8. Disclaimers and Limitation of Liability

All Products and Services are provided "AS IS" without warranty of any kind. FFG disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, FFG shall not be liable for any indirect, special, incidental, or consequential damages. In no case shall FFG’s aggregate liability exceed the amount paid by you in the prior twelve (12) months for the applicable Service.


9. Governing Law and Disputes

These Terms shall be governed by the laws of the District of Columbia. Disputes shall be resolved via binding arbitration, with location limited to Washington, D.C., and subject to the dispute resolution and class action waiver provisions contained in the full Terms of Use.

This Agreement represents the full Terms of Use for all FFG platforms and replaces any prior agreements related to your use of Equio™, NXTeck™, MarketEQ™, ShopEQ™, or AdEQ™ unless superseded by a signed, written contract.

 

Section 2: Nonprofit, Advocacy, and Mission-Driven Organizations

Purpose and Scope

NXTeck recognizes that nonprofit organizations, charitable organizations, advocacy organizations, social welfare organizations, foundations, membership organizations, and other mission-driven institutions operate under a different set of expectations than commercial enterprises.

For these organizations, supporter trust, donor stewardship, mission integrity, privacy, and long-term relationships are often more valuable than short-term campaign performance.

Accordingly, NXTeck applies the following principles and practices when providing audience intelligence, activation, measurement, attribution, fundraising support, supporter acquisition, engagement optimization, and related services to nonprofit and advocacy organizations.

These provisions supplement all other Terms and Conditions and apply specifically to nonprofit, advocacy, and mission-driven engagements.

 


Supporter Relationship Ownership

NXTeck does not own supporters.

NXTeck does not acquire ownership rights in donors, volunteers, petition signers, subscribers, event registrants, members, advocates, or any other individuals who engage with an organization's mission.

Supporter relationships belong exclusively to the organization with whom the individual chooses to engage.

Any individual who voluntarily:

  • makes a donation;
  • signs a petition;
  • subscribes to communications;
  • registers for an event;
  • volunteers;
  • joins a membership program; or
  • otherwise engages through an organization-controlled property

shall be considered a supporter of that organization and not of NXTeck.

NXTeck claims no ownership interest in such relationships.

 


Donor and Supporter Data Ownership

All supporter, donor, volunteer, subscriber, registrant, member, and participant information collected through organization-owned websites, donation pages, petitions, forms, event registrations, applications, or engagement properties shall remain the sole and exclusive property of the organization.

NXTeck shall not acquire ownership rights in such information.

Organizations retain full ownership and control of:

  • supporter records;
  • donor records;
  • communication preferences;
  • consent records;
  • donation histories;
  • volunteer information;
  • event registrations; and
  • engagement data collected directly by the organization.


Audience Modeling and Audience Expansion

Organizations may choose to provide supporter, donor, subscriber, member, volunteer, voter, customer, constituent, or other audience files to NXTeck for the purpose of audience modeling and campaign optimization.

Provision of such files is entirely voluntary.

NXTeck maintains extensive proprietary audience intelligence capabilities and may develop audience models using:

  • behavioral attributes;
  • voter records;
  • geographic intelligence;
  • consumer intelligence;
  • audience engagement patterns;
  • proprietary models; and
  • other lawful data sources

without requiring an organization to provide supporter files.

Where an organization elects to provide audience data, NXTeck may use that information solely for purposes directly related to that organization's engagement.

Organization-provided data shall not be:

  • sold;
  • rented;
  • licensed;
  • transferred;
  • disclosed to third parties; or
  • repurposed for unrelated client engagements.


No List Sales or List Rentals

NXTeck does not sell supporter lists.

NXTeck does not rent donor lists.

NXTeck does not transfer nonprofit supporter files between clients.

Audience development, audience expansion, behavioral modeling, and audience identification are not list sales.

NXTeck's role is to identify individuals who may be likely to engage with a particular issue, cause, mission, campaign, or organization based upon lawful audience intelligence and behavioral analysis.

Only when an individual voluntarily engages with an organization does a supporter relationship become established.


Data Stewardship Principles

NXTeck believes that audience intelligence should be used to strengthen relationships rather than exploit them.

For nonprofit and advocacy organizations, trust is more important than reach.

Accordingly, NXTeck's objective is not to maximize the amount of information collected about supporters. Rather, the objective is to help organizations identify, engage, and better understand individuals who choose to participate in their mission.

NXTeck will utilize commercially reasonable administrative, technical, and organizational safeguards designed to protect client information and supporter-related information used in connection with nonprofit engagements.


Privacy and Consent

NXTeck does not provide organizations with personally identifiable contact information unless that information is voluntarily supplied by an individual through an organization-controlled property.

Organizations are responsible for:

  • obtaining required consents;
  • maintaining communication permissions;
  • honoring unsubscribe requests;
  • complying with applicable privacy laws;
  • complying with charitable solicitation laws; and
  • complying with fundraising regulations applicable to their activities.

NXTeck may assist in measuring engagement and campaign performance but does not assume responsibility for an organization's compliance obligations.

 


Fundraising, Supporter Acquisition, and Attribution

NXTeck may provide services related to:

  • fundraising;
  • donor acquisition;
  • supporter acquisition;
  • audience development;
  • engagement measurement;
  • attribution;
  • message testing; and
  • campaign optimization.

Any fundraising attribution, audience attribution, engagement attribution, or campaign reporting provided by NXTeck is intended to support decision-making and performance evaluation.

Such reporting does not constitute:

  • audited financial reporting;
  • accounting services;
  • campaign finance reporting;
  • tax reporting; or
  • legal compliance reporting.

Organizations remain responsible for their own accounting, reporting, and regulatory obligations.

 


Message Testing and Audience Learning

NXTeck may assist organizations in evaluating:

  • audience response;
  • supporter engagement;
  • fundraising performance;
  • message effectiveness;
  • issue resonance; and
  • engagement patterns.

Organizations remain solely responsible for:

  • policy positions;
  • advocacy positions;
  • fundraising claims;
  • campaign content;
  • public communications; and
  • mission-related messaging.

NXTeck provides measurement, optimization, and audience intelligence services and does not serve as a substitute for organizational leadership or subject matter expertise.

 


501(c)(3) and 501(c)(4) Organizations

Where NXTeck provides services to both a charitable organization and an affiliated advocacy organization, including but not limited to 501(c)(3) and 501(c)(4) entities, NXTeck shall make commercially reasonable efforts to maintain separate:

  • billing;
  • reporting;
  • campaign measurement;
  • audience definitions;
  • fundraising reporting;
  • attribution reporting; and
  • campaign administration

as directed by the client organization.

The client organization remains solely responsible for ensuring compliance with all laws, regulations, restrictions, reporting requirements, fundraising rules, lobbying rules, campaign finance requirements, charitable solicitation requirements, and tax obligations applicable to its activities.

 


Advocacy and Public Policy Organizations

NXTeck provides technology infrastructure, audience intelligence, activation, measurement, and optimization services.

NXTeck does not provide:

  • legal advice;
  • tax advice;
  • lobbying advice;
  • campaign finance advice;
  • election law advice; or
  • regulatory compliance advice.

Organizations are responsible for determining the legality and appropriateness of their activities.

 


Data Retention and Termination

Upon termination of an engagement, organization-owned supporter, donor, volunteer, subscriber, member, and participant information shall remain the property of the organization.

Upon written request and subject to applicable law, NXTeck will make commercially reasonable efforts to delete organization-provided audience files and organization-owned supporter information from active campaign environments within a commercially reasonable period.

This provision shall not require deletion of:

  • aggregated reporting;
  • anonymized analytics;
  • historical campaign performance metrics; or
  • information required to be retained by law.
